Q: What documents are required to file case against defaulting builder in NCLT?

Ans: 1. Builder-Buyer agreement showing the amount and due date of possession.

2. Copy of authorisation from home buyers.

3. Details of the builder.

4. Particulars of the applicants( home buyers).

5. Date of an agreement.

6. Actual date of possession as per builder- buyer agreement.

7. Proof that property is still not delivered.

8. Charges for filing application in NCLT is Rs 25,000.

9. Take lawyer's advice.

10. Lawyer can advise on procedural aspects of application for insolvency.

11. When the application is filed for triggering insolvency under section 7 then IRP's name has to be there.  NCLT also then confirms it.

Then the resolution professional presides over the company.
